Construction liens under New Jersey law
Construction companies, contractors and subcontractors depend on collecting full, timely payment for the work they have done. When a property owner refuses to provide the contracted amount, a construction lien allows the victimized party to claim an interest in the property where they performed the work until the balance is paid off. However, there are strict requirements under New Jersey’s Construction Lien Law that must be satisfied, including deadlines that must be met for the lien to be imposed. Within 60 days of the final day when labor or materials were supplied, a Notice of Unpaid Balance and Right to File Lien must be submitted to the county clerk and then served upon the property owner within 10 days after submission. The lien itself must be filed within 120 days from then the project end. Our firm guides clients through the entire process of perfecting a lien, including arbitration proceedings when a dispute exists over the underlying facts. We also represent property owners who believe that a construction lien is not warranted.
